This is a very complicated and overwhelming subject. It especially gets complicated when you start to think about the global context. When the issue arises internationally which countrys' laws will be followed? Should we develope a global legal system specifically for cyberspace?

How to deal with, as Larry Lessig said, the lawless nature of technology, is something that will evolve in time. As time passes, more lawsuits regarding the issue will have settled. With more lawsuits settled, there will be more case law to refer to. And as more case law developes, the more we will understand how to deal with these issues. I think that at the rate technology advances we will have to find some fundamental guidelines that can be applied to technology in general. Beyond that we will have to go on a case by case basis.

It's also possible that education can be an assest in controlling these issues. With most issues, eduction is necessary to help reduce the risk/damage/harm. If everyone were aware of the potential issues with any sort of new technology they could choose to take whatever steps possible to protect themselves.
