Identifying the Novelty in Designs: A Design Patent Examiner’s Guided Exploration of How to Better Understand the Hermeneutics of “Novelty” in Design Patents and Utilize Patents in the Design Classroom.

Abstract

The purpose of this workshop is to illuminate the design patent, and deepen the designer and design educator’s understanding of its: intent, procedural examination process, and ways it can be utilized to provide rich context into how humans create, define and assess novelty through a hermeneutical process. By looking at current design patent examination practices, using historical patent databases as a research library, and philosophically examining “novelty” that is emphasized through design patents, participants will create their own hermeneutical cycle of understanding and engagement with novelty and innovation through the arena of designs.
