Abstract
This article analyses of the Judicial decisions handed down between October 2011 and January 2012 in the Judicial Action of Reintegration of Possession that expelled more than 6,000 people from the area known as “Pinheirinho”, located in São José dos Campos, São Paulo, belonging to the “Failed Mass of the Selecta”, elucidating how the Judiciary, in tune with the Executive and Legislative Powers, in the municipal sphere, considered the case as “a matter that affects private law, despite the number of persons affected by the order and the constitutional guarantee of the right to housing.
