Evaluation of Brazilian Solid Waste Legislation Effectiveness

Abstract

The production of solid waste by the population is a worldwide environmental concern, especially those produced in urban centers. On August 2, 2010, a law was sanctioned to establish the Brazilian Solid Waste Policy (BSWP). Thus, Brazilian municipalities must implement an integrated waste management plan that includes the diagnosis of the solid waste situation; the provision of mechanisms for the creation of sources of business, employment and income (main to waste pickers); and waste with special characteristics (such as health service waste). Properly applied, BSWP tends to reduce the consumption of natural resources and open new markets, generating work, employment, income, and social inclusion, as well as reducing environmental impacts and consequently preserving the environment. Therefore, aimed to evaluate the effectiveness of BSWP, this study was conducted by data analysis from the historical series 2010 - 2018 found in the report entitled “Brazilian Solid Waste Overview” produced and available by the Brazilian Association of Public Cleaning and Special Waste Companies (ABRELPE). Although it is of great importance for the socio-environmental issue presented, the results have shown that the PBRS is not effective, especially concerning the reduction of the financial support for the collection of waste and the non-extinction of inappropriate disposal sites (dumps). It is also important to highlight that the eradication of dumps, which should have first occurred in August 2014, has been extended to 2021, and that the improper final disposal of this material is considered a Brazilian environmental crime. Currently, Brazil has 1,610 dumps.
