Right to Food and Food Security: Achieving Universal Human Rights

Abstract

Right to food is a basic human right. It is states obligation to provide basic food requirements to its citizens. The Sustainable Development Goals (SDGs) 1 and 2 on eradicating poverty and achieve zero hunger, obligates the world nations to enact laws and initiate effective steps to achieve these SDGs. Furthermore, the concept of food security and distribution of food without discrimination is maintained by the states. The Indian Constitution acknowledges right to food as a basic right and various land mark judgements recognizes it. India, a nation with rich biodiversity and agriculture a major sector, has confronted few situation on drought and famine. But the national policies and schemes on food security has given a greater strength in achieving distribution of food materials without discrimination. India has also enacted the National Food Security Act, 2013 for effectively regulating food security in India. This paper examines the stand of India in right to food and food security. The current research work explains right to food in constitutional, legal and human rights perspectives. Relevant literature is analysed. The conclusion recommends for realization of political authorities and as signatory to any of the fundamental human rights treaties (including the ICESCR), India must consider the advice of treaty bodies or processes including the Universal Periodic Review and the Special Rapporteur on the right to proper food as part of its legislative oversight mandate.
