Intellectual Property Rights of Visual Arts in Iran: A Pathological Study

Abstract

The intellectual property rights (IPR) of the artwork is a clear topic. However, the mechanism of this law is not so easy for Iran. Many countries have become members of international treaties over time, but for various reasons, such as economic sanctions and the inability to buy and sell property rights for Iran (especially in the field of IT and software, medical, mechanical, etc.), lack of cultural and social readiness in order to restrict IPR and to continue to implement it, it has not yet been possible for Iran to subscribe to these agreements unconditionally. The hypothesis of the present study is that the problems regarding the IPR for artworks in Iran are probably because of the sanctions and the boundaries in political and economic affairs between Iran and the West. The purpose is to explain and analyze the effects of the sanctions and Iran’s relationship with the West on the IPR of the artworks in Iran; and to describe how a political bias is affecting the career of the artists, with an analytical-descriptive methodology. Thus the conclusion is that political bias of the West regarding the sanctions may have influenced the artistic careers instead of Iran’s political outlook.
