Exploring the Governance Path of UNCLOS in Addressing Climate Change: A Cross-fertilization Approach

Abstract

The paper analyzes the intersections between the law of the sea and climate change law, this paper highlights the inadequacies of the current legal framework in addressing the impact of climate change on the oceans, including ocean fertilization, ocean acidification, and rising sea levels. It is necessary to address these shortcomings through the implementation of appropriate legal measures. The responsibilities of States to address the climate crisis are strengthened by interpreting, developing, and implementing the law of the sea framework to support the main objectives of the United Nations climate regime, as well as by complementing, harmonizing, refining, and improving the law of the sea framework. The article suggests several pathways for governing the law of the seas, such as creating a unified institution to tackle climate change and ocean governance, enhancing the interpretation and implementation of current provisions, utilizing appropriate framework agreements to tackle ocean acidification, and clarifying the potential use of dispute settlement procedures in handling climate change disputes. The objective of these measures is to deliver sturdy resolutions to the international community and tackle interrelated matters such as climate change and legal ocean management.
