Corporate Social Responsibility for Climate Change Impacts by Multinational Corporations in Africa: A Poor Apology for Absence of Direct Liability

Abstract

The paper interrogates and challenges in equal measure the narrative of Corporate Moral Responsibility (CMR) of corporations to decarbonize the globe as a substitute for legal measures in international law. It inquires into the liability of fossil fuel Multinational Corporations in Africa (MNCs) in international law and how such liability can be enforced under international climate change regulatory framework. The question of liability of MNCs in international law is an extremely fecund academic debate that seems to yield more questions than answers. To avoid reinventing the wheel, this discussion not only delimits liability to the difficult question of climate change, but also sifts through the body of literature on this subject to make appropriate suggestions in the climate change context.
