Abstract
The climate change threat poses several challenges to the law fraternity. The wide-ranging consequences of climate change are witnessed all over the world. Several attempts are ongoing to address climate change consequences through regulation and legislative intervention. Such interventions result in treaty-based law-making inter-alia, UNFCC, the Kyoto Protocol to the Paris Agreement, 2015. A common element of these treaties remains to be financial assistance and financial commitment to mitigate and adapt to climate change. Though climate finance is a key element in these treaties, they hardly find mention in domestic legislation. Against this backdrop, the researcher intends to analyse the possibility of introducing obligations of finance and contributions that can be made by private individuals and corporations to address climate change through suitable amendments and modifications in the Securities Laws of nations. Following the bottom to top approach, the topic is framed to research local law initially and hence is restricted to understand the suitability of changes that can be brought in India. To attain the desirable result, a survey and exploratory research would be conducted of varied securities laws and regulations that are in force highlighting the existing gaps, if any, in the existing law. The research intends to suggest the introduction of new provisions wherever required or suggest amendments to the existing provisions to include climate change finance to make securities laws of India all-inclusive and a self-sufficient code.
