Abstract

The U.S. Congress passed Title IX of the Education Amendments Act in 1972. It prohibits gender discrimination in schools and other educational programs. The implementation of Title IX in the area of collegiate athletics has been discriminatory as it has eliminated some male athletic programs and roster spaces in order to meet the requirements of Title IX. In eliminating male athletic programs to meet the three prongs, male collegiate athletes have faced discrimination under Title IX and the U.S. Constitution. What was meant as a law to “level the playing field” and create more inclusion of athletes both male and female, has eliminated the playing field for male athletes at U.S. colleges.
